Designs
are protected by the Design Law. Under the
Design Law a design is defined as the shape,
pattern, color or any combination thereof
in the article which produces an aesthetic
impression in the sense of sight. The term
"article" is generally considered
as a tangible, movable and independent thing.
Non-examination system of design is to protect
articles with short commercial life cycles
(i.e., textiles), and a design right is granted
after the application is examined only for
minimum legal requisites for registration.
Also, applicants may request that the design
be kept secret for a certain period and it
shall not exceed 3 years from the registration
date. In case of multiple design application,
the request shall be made for all designs.
The term of the design right is 15 years from
the registration date.
